CBI accuses lawyer for Anil Deshmukh of trying to influence investigation against him
The CBI has registered an FIR against the lawyer of former Maharashtra Home Secretary Anil Deshmukh for allegedly trying to influence the preliminary investigation led by the Bombay High Court into corruption allegations against the leader, officials said on Wednesday.
The CBI also questioned attorney Anand Daga on Wednesday for allegedly attempting to pay “an illegal gratuity” to a non-commissioned officer in the agency’s sub-inspectorate to “modify the preliminary investigation,” they said,
A preliminary investigation report allegedly giving Deshmukh good agreement was leaked on Saturday evening.
The CBI has opened an investigation into the leak which has so far revealed that Deshmukh’s team allegedly attempted to influence PE’s conduct against him by paying an illegal gratuity to an agency sub-inspector, said the responsibles.
The central agency examined Deshmukh’s son-in-law Gaurav Chaturvedi and lawyer Anand Daga on Wednesday as part of its investigation, after which an FIR was registered, they said.
The CBI has not found Chaturvedi’s involvement so far and he has been cleared to go, they said.
“The attempt by Anil Deshmukh’s team was in contempt of the Bombay High Court which ordered all concerned to cooperate fully with the CBI when conducting the EP. In this case, it emerged that Deshmukh’s team tried to overthrow the EP, ”an official told PTI. .
Their attempt could not be successful because there is a procedure within the CBI in which recorded evidence and legal opinions are also recorded before the FIR is registered, he said.
“They couldn’t influence people at a higher level,” he said.
The CBI had launched an MOU on the orders of the Bombay High Court which had issued the instruction during the hearing of a public interest dispute over allegations of corruption against Deshmukh.
The claimed PE findings that were leaked showed that the deputy SP investigating the case allegedly felt that no identifiable breaches had been established against Deshmukh.
It was then transformed into FIR on the basis of a contrasting opinion of MP SP. The opinion mentioned in the FIR stated that the recognizable offense is established against Deshmukh.
“The preliminary investigation has revealed a prima facie case that a recognizable breach has been established in the case, in which then Maharashtra-era Home Secretary Shri Anil Deshmukh and other unknowns attempted to obtain undue advantage for the inappropriate and dishonest exercise of their public duty, “CBI FIR alleged.
In the FIR, the CBI convicted Deshmukh and others unidentified under the IPC articles on criminal association and the Prevention of Corruption Act for “attempting to gain unfair advantage for the inappropriate and dishonest exercise of a public duty ”.
Allegations against Deshmukh surfaced after the dismissal of Mumbai Police Commissioner Param Bir Singh.
He was dismissed from his post after the role of police officer Sachin Waze surfaced in the case of an explosives-laden SUV that was found parked outside the residence of industrialist Mukesh Ambani. Waze has been arrested by the NIA.
In his letter to Chief Minister Uddhav Thackeray, after his impeachment, Singh alleged that Deshmukh asked Waze to extort ??100 crore per month in bars and restaurants in Mumbai, they said.
The FIR alleged that Deshmukh “and others” exercised undue influence over the transfer and posting of officials.
